TRUANCY
Pursuant to Section 3321.191, Revised Code, the Governing Board is required
to adopt a policy with regard to habitual truants. Also, pursuant to Section
3313.609, Revised Code, the Governing Board is required to adopt a policy on
the retention of truant students.
A. For the purpose of Section 3321.191, Revised Code, the Governing Board of
Education of the Clermont County Educational Service Center, after
consultation with the Juvenile Court of Clermont County; with parents,
guardians or other persons having care of pupils and with appropriate state
and local agencies, adopts the following policy:
1. The Governing Board may assign the habitual truant to an alternative
school if one is available.
2. The Governing Board may require the truant to participate in a truancy
intervention program.
3. The Governing Board may require a habitual truant to undergo appropriate
counseling.
4. The Governing Board may require the parent, guardian or other person
having care of the child to attend a parental involvement program adopted
under Section 3313.472 or 3313.663, Revised Code.
5. The Governing Board may require the parent, guardian or other person
having care of the child to attend a truancy prevention mediation program.
6. The Governing Board may notify the Registrar of Motor Vehicles of a
habitual truant under Section 3321.13, Revised Code.
7. The Governing Board may take legal action under Section 2919.222, 3321.20
or 3321.38, Revised Code.
8. The following definitions shall apply for the purpose of policy “A”:
A. “Chronic Truant” means any child of compulsory school age who is absent
without legitimate excuse for absence from the public school the child is
supposed to attend for seven or more consecutive school days, ten or more
school days in one school month, or fifteen or more school days in a school
year.
B. “Habitual Truant” means any child of compulsory school age who is absent
without legitimate excuse for absence from the public school the child is
supposed to attend for five or more consecutive school days, seven
or more school days in one school month, or twelve or more school days in a
school year.
B. For the purpose of Section 3313.609, Revised Code, the Governing Board
adopts the following policy:
1. The Governing Board shall prohibit the promotion of a student to the next
grade level if the student has been truant for more than ten percent (10%)
of the required attendance days of the current school year, and,
2. Has failed two or more of the required curriculum subject areas in the
current grade.
3. The provisions of #1 and #2 above may be waived if the student’s
principal and teachers agree, in writing, that the student is academically
prepared to be promoted to the next grade level.
4. The following definitions shall apply for the purposes of policy “B”:
A. “Truant” means absent without excuse.
B. “Academically prepared” means whatever educational standard the Governing
Board of the Clermont County Educational Service Center establishes as
necessary for the promotion of a student to the next grade level.
