ESC GOVERNING BOARD POWERS AND DUTIES
Under the laws of the State of Ohio, the Governing Board acts as
the governing body of the Educational Service Center.
Within the extent of its legal powers, the Governing Board has
responsibilities for conducting the system in accordance with the desires
of local citizens who elect its members.
The Governing Board considers the following to be its major
responsibilities:
1. to select and employ a Superintendent;
2. to select and employ a Treasurer;
3. to determine and approve the annual budget and appropriations;
4. to consider and approve or reject the recommendations of the
Superintendent in all matters of policy, appointment or dismissal of
employees, salary schedules, courses of study, selection of textbooks and
other matters pertaining to the operation of the schools;
5. to adopt policies for its governance and the governance of its
employees and the students of the schools;
6. to hold the organizational meeting within the month of January;
7. to maintain lists of textbooks for local school districts subject to
the right of each local school district to select from said list the books
to be used in that district;
8. to provide for physical examination of bus drivers; (R.C. 3327.10)
9. to issue certificates of qualification to school bus drivers; (R.C.

10. to rule on transportation when local board does not provide; (R.C.

11. to act in the place of a local board of education and perform its
duties in the case where a local board does not fill a vacancy as required
by law, or fails to perform a duty imposed upon it by law; (R.C. 3313.85)
12. to make an equitable division of funds between the districts involved
when it creates a new local school district from one or more local
districts or parts thereof and when it transfers a part of a local school
district to an adjoining district; (R.C. 3311.22, 3311.231, 3311.26)
13. to issue an annual report of school progress in accordance with
guidelines established by the State Board of Education; (R.C. 3313.94)
14. to adopt rules entitling regular classified employees to a minimum of
three days of personal leave at employees regular compensation; (R.C.

15. to adopt policy regarding sick leave and severance pay consistent with
law; (R.C. 124.39, 143.291)
16. to employ persons without regard to race, color, religion, sex,
national origin, handicap age, citizenship status, ancestry or other human
differences in all terms, conditions and privileges of employment and (R.C.

17. to provide supervisory services to local school districts. (R.C.
3317.11)
PERMISSIVE DUTIES OF AN EDUCATIONAL SERVICE CENTER
1. Establish a service fund not exceeding such amount as may be approved
by the State Board of Education to be used for the purposes authorized by
law. (R.C. 3315.15)
2. Appoint one or more assistant superintendents and such other
administrative officers and employees as are necessary. (R.C. 3319.02)
3. Assign to such employees such administrative duties as are not in
conflict with law or imposed on any other officers or employees by law.
4. Allow the Superintendent and Assistant Superintendents each a sum not
exceeding that specified by law for traveling expenses with the Clermont
Educational Service Center. (R.C. 3315.06)
5. Determine the method of paying its employees and fix the compensation
for same. (R.C. 3315.08)
6. Provide materials, supplies and equipment for the use of its
Superintendent in furthering the instructional program of the county
school district. (R.C. 3315.06)
7. Provide funds for bulletins and materials necessary for the effective
administration of the Clermont County Educational Service Center. (R.C.
3315.07)
8. Expend funds for conducting studies pertaining to school district
organization, building needs, curriculum and instructional needs, improved
and additional services for county boards of education, and for publishing
reports and studies. (R.C. 3315.061)
9. Employ stenographers and clerks. (R.C. 3315 .06)
10. Enter into contractual agreements for cooperative services. (R.C.
3313.841)
11. Purchase or lease motor vehicles. (R.C. 3313.172)
12. Join a school boards association and pay the dues permitted by law. (R.C.
3313.87)
13. Establish and maintain classes for mentally and physically handicapped
persons subject to approval by the State Board of Education. (R.C.
3317.11, 3323.01)
14. Propose the transfer of a part or all of one or more local districts
to an adjoining school district. (R.C. 3311.22, and 3311.231)
15. Set effective date for transfer of school territory prior to July 1 of
any year. (R.C. 3311.22, 3311,231, 3311.26)
16. Propose the creation of a new local school district from one or more
local school districts or parts thereof. (R.C. 3311.26)
17. If it owns property other than trust property not authorized to be
sold, may dispose of such property according to law. (R.C. 3313.41)
18. Employ assistant attendance officers. (R.C. 3321.15)
19. Call educational meetings and pay expenses of same, and call a meeting
of all local boards of education at least once a year. (R.C. 3315.06)
20. Accept any gift, property or endowment, and administer the same. (R.C.
3313.17, 3313.36)
21. Purchase for local school districts and accept donations of supplies
and equipment and pay the transportation, handling and storage charges as
well as the cost of the merchandise subject to authorization and
reimbursement of the boards of education of such local school districts. (R.C.

22. Establish and operate a joint vocational school district. (R.C.
3311.16 et seq.)
23. Purchase liability insurance. (R.C. 3313.203)
24. Expend funds for consultant services. (R.C. 3313.171)
25. Contract for sharing services. (R.C. 3313.841)
26. Request a JVSD Board of Education to revise district plan to allow
local board members to serve in place of county board members. (R.C.
3311.19)
27. Build, enlarge, repair and furnish and the necessary facilities for
conducting special education programs and driver education courses. (R.C.
3313.37(A))
28. Operate an adult high school continuation program. (R.C. 3313.531)
