PUBLIC'S RIGHT TO KNOW
In fulfillment of the rationale for the creation of public governing bodies,
the meetings are public and records of the Governing Board are public
information.
Educational matters will be discussed, and decisions will be made, at public
meetings of the Governing Board, except such matters as are properly
discussed in private executive sessions.
The official minutes of the Governing Board, its written policies and its
financial records will be open for inspection in the office of the Treasurer
during the hours when the administration offices are open.
The Governing Board supports the right of the people to know about the
programs and services of their schools and will make efforts to disseminate
appropriate information.
The Governing Board recognizes the importance of public records as the
record of the acts of the Educational Service Center and the repository of
information about the Educational Service Center. Members of the public have
the right to inspect and copy, with certain exceptions, the public records
of the Educational Service Center.
Public records shall mean any record that has been required by law to be
kept by this Governing Board or its officials, except records pertaining to
physical or psychiatric examinations, adoption, probation and parole
proceedings, and records the release of which is prohibited by State or
Federal law.
The Governing Board shall make the public records of the Educational Service
Center available to the residents of this State for inspection and copying
with exception of those records exempted from such inspection and copying by
law.
Any resident of the State may inspect and copy the public records of the
Educational Service Center, except exempted records, during the regular
business hours of the office in which such records are maintained, except
that of the custodian of the record may require advance notice of not more
than one working day when immediate inspection or copying will unduly burden
the custodian or frustrate the administration of his/her office.
A resident may purchase copies of the public records of the Educational
Service Center upon the payment of a fee equivalent to the cost of handling
and reproduction.
No public record may be removed from the office in which it is maintained.
Nothing in this policy shall be construed as preventing a Governing Board
member from inspecting, in the performance of official duties, any record of
the Educational Service Center except student records.
The Superintendent shall develop procedures to implement this policy which
include preparation of a retention schedule which shall require the
permanent safeguarding of Governing Board minutes, personnel files, annual
audit reports and permanent student records and the retention of all fiscal
records required for audit until said audit has been received and approved.
The Educational Service Center Records Commission shall be established
consisting of the Governing Board President, Treasurer and Superintendent,
in accordance with law, to judge the advisability of destroying records.
